Agreement Terms and Conditions Any outstanding payments are required on the day of the session. This does not apply to any booking made via our pay later service with clearpay. The photographer retains the exclusive right to copy, edit and distribute any images created under this agreement, including but not limited to: advertising, marketing and sales. A private online gallery will be sent to the client where the images can then be downloaded. Delivery of digital images can take up-to 7 days and for prints 28 days from the date of payment. The photographer will not edit, send or order any photos until the full payment has been made. Please only download the 5 images you would like included in your package. Downloading images count towards your included digital allowance and this cannot be reversed. If you would like to upgrade your package to include extra images please head to 'upgrade package' for more information. Once you have downloaded the images you have chosen, these will automatically download without the watermark and can be located in the downloads folder of your device. All images must not to be edited after receiving them which includes adding filters to images during upload to social media platforms. Any request for RAW files will be denied. The photographer is not responsible for the quality of prints that are purchased at other retailers outside of Lo Thompson Photography. The photographer has the right to terminate the session if they experience inappropriate, threatening, hostile or offensive behaviour and is not responsible if key individuals fail to appear or do not cooperate during the session. The Client agrees that he/she is responsible for all parties involved with the agreed upon photo session. If there is an individual involved in the photo session who does not agree to the terms of this agreement the Client assumes responsibility for any liability. If the Client cancels the session they agree to forfeit the deposit paid or any money paid via Clearpay and understand there will be no refunds of the any money that has already been paid. Client will have 7 days after the gallery is delivered to make photographer aware of any issue, discrepancy or technical problem regarding the gallery. The Photographer does not permanently archive image files. The online gallery will be live for 3 months after the date of the session. It is the responsibility of the client to make sure that digital files are downloaded and saved as required. In the unlikely event that all the original images are lost, stolen, damaged or destroyed within or beyond Photographer’s control, the photographer liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date.
